Mediation in labor relations

On April 20, 2017, the occupation of the School of mediation and national diplomacy of department of Assembly of the people of Kazakhstan took place in the House of friendship of KSU "Қоғамдық келісім". Guests were welcomed by the professional mediators of an office of mediation –the lawyer Olga Kravchenko and the psychologist Marina Navoyeva. The goal is to designate specifics of carrying out mediation in labor disputes which often are an integral part of labor relations. Students of institute – are the students of the school of mediation and national diplomacy and teachers participated in the action: the dean of the faculty of the additional education, S. V. Samarkin managing department of Assembly of the people of Kazakhstan, O. N.Evdokimova, associate professor of the Assembly of the people of Kazakhstan, doctor of PhD M. M. Kozybayeva.
On the basis of KSU "Қоғамдық келісім" akimat of the Kostanay region the office of mediation and telephone hotline concerning mediation for representatives of ethno cultural associations in particular, and all civilian population of the Kostanay region functions. Council of mediators which part experts of various areas of knowledge – are doctors and candidates of philosophical, pedagogical, legal, psychological sciences, members of the Assembly of the people of Kazakhstan, representatives of various ethno cultural associations were created. Active cooperation with Association of Mediators of the Kostanay Region is conducted.
Olga Kravchenko noted that mediation is not new to a labor law. The institute of mediation is applied to settlement of disputes for a long time, however is directed only to collective labor disputes. In the course of mediation despite the fact that what disputes are resolved – collective or individual, only three parties are all the same presented, including an intermediary mediator. Mediation is intended to induce the parties not to solve, namely to settle a dispute. At the same time for all mediators the main condition of mediation in settlement of the conflicts is impartiality. The main goal of a mediator – is to support both partners in the conflict and to remain neutral.
The usage of mediation in labor relations is inevitable also because personal can press on these relations, therefore, the person, the intermediary who will be able to organize communication of the arguing parties so that the mutual decision which will be voluntarily executed was made is necessary. The mediator is the neutral third party accompanying process for resolution of conflict and for the achievement of the concrete agreement. By means of the mediators, it is possible to find solutions at which will not be won, winners.
Occupation was followed by the discussion of the domestic legislation on mediation within the labor disputes, and also analysis of concrete examples and holding practical training: the game "Gift heart" and educational mediation during which students had an opportunity to act as a mediator and to resolve a concrete labor dispute. As a result of the carried-out meditation, listeners managed to resolve the conflict and to lead the parties to the uniform agreement.
The staff of the department of the Assembly of the people of Kazakhstan, and also the faculty of additional education of the Kostanay state teacher training college expresses gratitude to employees of the office of mediation at KSU " Қоғамдық келісім” akimat of the Kostanay region for the given help in preparation of the mediators and hopes for further effective cooperation
